why is it so
important
to use videographers?
- Body Language. You must give a sense of tone to the jury.
Reading a deposition transcript to a jury sometimes makes it difficult for jurors to follow, but presenting a video recording of the deposition to the jury makes the testimony come to life.
Videotaping a deposition allows a jury to see what the person is like, their tone, any nervous habits, moments of pause, volume, idiosyncrasies of the witness, and facial expressions. It highlights their sighs, and any eye rolls, head shakes, and hand gestures that can add substance to their deposition. Video can record demeanor and just how long it takes to answer the questions posed by an attorney. Where a transcript may make it seem like an attorney is pressing multiple times over and over again with the same question, a video can show the stretch of time between question and answer. All of this goes directly to the witness’s credibility. This is one of many reasons it is imperative to videotape all depositions.
- It has a calming effect on disruptive attorneys and witnesses.
The act of having their testimony recorded has a calming effect on any emotional and high-strung witnesses, as well as their attorneys. It keeps participants from acting in a way that could disrupt the deposition. Videos also act as a deterrant to prevent the attorney from leading the witness. It is easy to alter the tone of a transcript, simply dependent upon how it is read aloud in trial, but videos played in trial speak the whole truth and give the jury a sense of reality for the situation.

In addition, videotaping a deposition allows for critical testimony of the video footage to be cropped, highlighted, and played in segments at mediation or trial. This can dramatically affect the value of the case at mediation, and it can also help in assisting the court in determining legal issues pre-trial or at trial. Playing short clips of footage from depositions can be extremely effective in making points throughout litigation.
Videos allow the legal team, co-counsel, insurance adjusters, and mediators to see how a witness will respond and act in front of a jury. This will help them decide if the witness will be a help or a hinderance in settling the case. Videotaping depositions has now become one of the essential elements to effectively and competently present a case at trial.
Furthermore, seeing a witness contradict themselves on video has a much stronger impact than hearing it read back on a transcript.
